TERMS OF SERVICE

These terms govern your use of peachyfresh.com.au and any products you purchase 
from us. By using our site or buying our products, you agree to these terms.

1. ABOUT US

This website is operated by Femme Fresh Pty Ltd 691 529 398 as trustee for 
the Living Water Trust (ABN 47 942 276 131), trading as Peachy Fresh. 
Throughout the site, the terms "we", "us", and "our" refer to Peachy Fresh.

2. ELIGIBILITY

You must be at least 18 years old to purchase from Peachy Fresh. By placing an 
order, you confirm you are 18 or over. Our products are intended for adult use 
in Australia only.

3. PRODUCTS

The Daily Slay and The Assassin are vaginal suppository products for adult 
women. Both are intended for vaginal insertion only and must not be ingested 
orally. Full usage instructions are on each product listing and on the 
packaging. If you are pregnant, breastfeeding, or have an existing medical 
condition, consult a healthcare professional before use.

The Assassin contains an active ingredient that is toxic if swallowed. Keep 
out of reach of children and pets at all times.

Our products are not intended to diagnose, treat, cure, or prevent any 
disease. We do not make therapeutic claims. Information on our website is for 
general educational purposes and is not medical advice. Always consult a 
qualified healthcare professional for medical concerns.

4. ORDERS AND PAYMENT

When you place an order, you make us an offer to buy the products at the 
listed price. We accept your offer when we send you an order confirmation 
email. We reserve the right to refuse or cancel any order — for example, if 
a product is out of stock, the price was incorrectly displayed, or we suspect 
fraud.

All prices on peachyfresh.com.au are in Australian Dollars (AUD) and include 
GST where applicable. Shipping is calculated at checkout.

We accept payment via the methods shown at checkout. By providing payment 
information, you authorise us to charge your chosen method for the total order 
amount.

5. SHIPPING AND DELIVERY

full details on delivery times, costs, and processes. We ship within Australia 
only at this time.

Risk of loss passes to you when the package leaves our warehouse. We are not 
liable for delays caused by Australia Post or third-party couriers, though we 
will assist with lost or delayed parcel claims (see Shipping Policy).

6. RETURNS AND REFUNDS

See our Refund Policy at peachyfresh.com.au/policies/refund-policy. Our 45-Day 
Money-Back Guarantee and Australian Consumer Law rights are set out in full 
there.

7. SUBSCRIPTIONS (if/when offered)

Some products are available on a subscription basis. By subscribing, you 
authorise us to charge your payment method on the recurring billing cycle you 
selected until you cancel. You may cancel anytime via your account dashboard 
or by emailing hello@peachyfresh.com.au at least 48 hours before your next 
billing date. No refunds for subscription orders already shipped — you can 
return unopened product under our standard 30-day return window.

8. INTELLECTUAL PROPERTY

All content on peachyfresh.com.au — including logos, product names ("Peachy 
Fresh", "The Daily Slay", "The Assassin"), copy, images, and design — is owned 
by us or licensed to us. You may not copy, reproduce, redistribute, or use our 
content for commercial purposes without written permission.

You may share product links and screenshots on personal social media in good 
faith.

9. USER CONDUCT

You agree not to:
- Use our site or products for any unlawful purpose
- Resell our products without authorisation
- Submit false or misleading reviews, ratings, or testimonials
- Attempt to access, scrape, or interfere with our systems or other users' 
  accounts
- Use our brand, logos, or content to mislead others about your affiliation 
  with us

10. PRIVACY

we collect, use, and protect your information.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Peachy Fresh is not liable for any 
indirect, incidental, consequential, or special damages arising from your use 
of our website or products. Our total liability for any claim is capped at 
the amount you paid for the relevant order.

Nothing in these Terms excludes, restricts, or modifies any guarantee, 
condition, warranty, right, or remedy you may have under the Australian 
Consumer Law that cannot lawfully be excluded. Where ACL applies and a 
product is faulty, you're entitled to remedies as set out under that law.

12. INDEMNITY

You agree to indemnify Peachy Fresh against any claim, loss, or expense 
arising from your breach of these Terms or your misuse of our products 
(including using them in a way other than as directed on the packaging — for 
example, ingesting them orally).

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. The "Last updated" date at the 
top reflects the most recent version. Continued use of our site after changes 
means you accept the updated Terms. Material changes affecting existing 
customers will be emailed.

14. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia. Any dispute 
arising from these Terms or your use of our products is subject to the 
exclusive jurisdiction of the courts of Queensland.
